THREE DIFFERENT ALERT LEVELS: YELLOW, ORANGE OR RED 

The DPCM identifies restrictive measures applied to the entire national territory (so-called "yellow" zones), which are flanked by gradually more stringent measures for regions with a "type 3 scenario" (so-called "orange" zones) and those with a "type 4 scenario" (so-called "red" zones).  

The membership of regions in a given level of risk is determined by order of the Ministry of Health, after hearing the relevant presidents.  These ordinances are effective for a minimum period of 15 days, but no later than December 3. About the measures provided for the so-called "orange" or "red" zones, the Minister of Health, in the order in which he identifies the alert level, may determine that specific parts of the regional territory are exempt from the application of these measures In light of epidemiological risk trends.

The alert level in each territory is checked at least weekly. The persistence of a territory for 14 days in a risk level or scenario lower than the one that determined the restrictive measures results in a new classification. The measures for "orange" or "red" territories are applied from the day after the ministerial orders are published in the Official Gazette.

The Veneto Region has been identified as a "yellow zone."

YELLOW ZONES.

THE MEASURES IN FORCE THROUGHOUT THE COUNTRY (SO-CALLED "YELLOW" ZONES)

The DPCM incorporates verbatim almost all the measures already introduced by the previous decree of October 24, which therefore remain in effect. The main new features introduced are as follows.

  • Moving is prohibited from 10 p.m. to 5 a.m. the following day. It is possible to move only for proven business needs, situations of necessity or health reasons.
  • During the day, it is strongly recommended not to move, except for work, study, health reasons, situations of necessity, carry out activities or use services that are not suspended.
  • The closure to the public of streets or squares where gatherings may occur may be ordered, throughout the day or at certain times. In these areas, however, it remains possible to enter or leave to go to legitimately open businesses and private homes.
  • Regarding the activities of gyms, swimming pools, wellness and spa centers, only rehabilitative and therapeutic activities are allowed, as well as the provision of services within the essential levels of care. 
  • Museums and exhibitions closed.
  • Distance education for high schools, except workshops and activities for students with disabilities.
  • Distance learning for universities, excluding first-year students and laboratory activities.
  • Public and private training courses can only be conducted by distance learning. 
  • Suspended public competitions and bar exams, with specific exceptions. 
  • Closed sales activities in malls and markets during holidays and pre-holidays, except for some so-called essential activities.
  • Take-out catering is allowed until 10 p.m.
  • A filling ratio of no more than 50 percent is allowed on board public means of local and regional rail transportation.

In addition to Veneto, the yellow areas include Abruzzo, Basilicata, Campania, Emilia-Romagna, Friuli Venezia Giulia, Lazio, Liguria, Marche, Molise, Sardinia, Tuscany, Umbria, and the provinces of Trento and Bolzano.

ORANGE ZONES.

THE ZONES WITH TYPE 3 SCENARIO AND HIGH RISK LEVEL (SO-CALLED "ORANGE" ZONES)

In areas with type 3 scenario, additional containment measures are applied.

  • All movement in and out of these territories, as well as within them, is prohibited. Travel is permitted for proven work requirements, situations of necessity, health reasons, performance of teaching in attendance.
  • Return to one's home, dwelling or residence is always permitted.
  • Transit through these territories to reach unrestricted territories or in cases permitted by the DPCM is possible.
  • Traveling to a municipality other than one's residence, domicile, and home is prohibited, except for proven needs for work, study, health reasons, situations of necessity, carrying out activities, or taking advantage of services that are not suspended and not available in one's municipality.
  • Suspended food service activities, except canteens, continuous catering, home delivery, take-out catering until 10 p.m.
  • Always open food service establishments in highway service areas, highways and airports.

Included in the orange areas are Puglia and Sicily.

RED ZONES.

THE ZONES WITH TYPE 4 SCENARIO AND HIGH RISK LEVEL (SO-CALLED "RED" ZONES)

The following is a summary of additional measures applied in so-called "red zones."

  • All movement in and out of these territories, as well as within them, is prohibited. Travel is permitted for proven work requirements, situations of necessity, health reasons, performance of teaching in attendance.
  • Return to one's home, dwelling or residence is always permitted.
  • Transit through these territories to reach unrestricted territories or in cases permitted by the DPCM is possible.
  • Retail trade is suspended, except for the sale of food and basic necessities.
  • Suspended food service activities, except canteens, continuous catering, home delivery, take-out catering until 10 p.m.
  • Always open food service establishments in highway service areas, highways and airports.
  • Allowed motor activity only in the vicinity of one's home with mandatory use of PPE.
  • Allowed sports activities only outdoors and as individuals.
  • Distance education except for preschool, primary, and first year of secondary school, workshops, and activities with students with disabilities.
  • Distance learning in universities.
  • Suspended activities related to personal services, except those specifically listed in special annex to the decree.

Included in the red areas are Lombardy, Piedmont, Valle D'Aosta, and Calabria.

LABOR-RELATED MEASURES

WHAT MEASURES IN THE AREA OF LABOR?

The new DPCM reiterates the application of the National protocols adopted on April 24, 2020 for different production activities. Therefore, all measures established therein remain in force.

Some novelties concern public administrations, whereby:

  • Agile working mode should be implemented to the highest extent possible;
  • All useful solutions must be adopted to ensure smart working for workers during the compulsory quarantine of the cohabiting child and with respect to fragile workers, including by assigning them to a different task circumscribed in the same category or area of classification. 

For private employers, the following remains strongly recommended at all times. the use of agile work.

We also reiterate the recommendation that:

  • are incentivized vacation and paid leave, as well as other instruments established by collective bargaining;
  • are adopted anti-counterfeiting security protocols;
  • are encouraged the sanitation operations of workplaces, including using social shock absorbers.
